Information about the tariff structure of Gasunie Deutschland Transport Services GmbH as of 01.01.2023 being valid at cross-border points and storages
Gasunie Deutschland Transport Services GmbH (GUD) publishes the capacity charge for grid access in calendar year 2023, which is valid at cross-border points and storages (capacity charge).
Due to regulatory requirements (decisions “REGENT-GP” (BK9-18/611-GP) and “AMELIE”(BK9-18/607)), a postage stamp RPM is in place since 01.01.2020 and reference prices of GUD have been calculated accordingly. The regulatory requirements REGENT and AMELIE have been appealed by third parties. The Higher Court OLG Düsseldorf dismissed the appeals on 16th September 2020. The complainants have appealed to the Federal Court of Justice (BGH) against the decision of the OLG Düsseldorf. For the new German Market area Trading Hub Europe (“THE”) two new decisions REGENT 2021 (BK9-19/610) and AMELIE 2021 (BK9-19/607) were published by the BNetzA. These decisions have been appealed by third parties, too. As a result of possible legal disputes it cannot be excluded that regulatory requirements could be changed and thus the reference prices could be increased for the future and/or retroactively. Therefore GUD reserves the right to amend the reserve prices on the basis of legal / regulatory decisions. In addition, GUD reserves the right to request the difference between the reference price paid by the shipper and the new reference price established on the basis of a legal / regulatory decision.
The capacity charge for firm flexible allocable entry and exit capacities with a duration of one year amounts to:

Compared to 2022 the tariff for firm freely allocable entry and exit capacities in the THE market area will be around 37.3 percent higher. Due to the geopolitical situation, partly changed gas flows and as a result an adjusted booking behavior were assumed. In addition, the significant increase in the cost of driving energy also lead to an increased capacity charge.
The capacity charge for dynamically-allocable entry and exit capacities amounts to 80 percent and for conditionally firm freely allocable entry and exit capacities 90 percent of the respective applicable capacity charge for firm flexible allocable entry and exit capacities.
According to the decision BK9-21/612 (MARGIT 2023) a multiplier is to be applied at all interconnection points for the conversion from yearly standard capacity products to non-yearly standard capacity products. The multiplier of a within-day standard capacity product is 2.0, the multiplier of a daily standard capacity product is 1.4, the multiplier of a monthly standard capacity product is 1.25 and the multiplier of a quarterly standard capacity product is 1.1.
Reserve prices for standard interruptible capacity products at interconnection points shall be calculated by multiplying the reserve prices for standard firm capacity products calculated in accordance with Articles 14, 15 of Regulation (EU) No 2017/460 (NC TAR) and the decision BK9-19/610, (REGENT 2021) with the difference between 100% and the amount of the applicable ex-ante discount at the respective interconnection point for each standard capacity product in accordance with Annex I of the decision BK9-21/612 (MARGIT 2023).
For the amount of the discounts for capacity bookings at gas storage facilities and LNG entry points, which will be granted to the capacity charge for firm freely allocable capacity, we refer to the regulatory decisions valid for the calendar year 2023 (REGENT 2021, MARGIT 2023).
In addition, the regulations of BEATE 2.0 (BK9-18/608) and the amendment of BEATE 2.0 BK9-20/608 are applied to capacity bookings at storages.
